Terms of Service

Welcome to Oyeba. By using our service, you accept these terms. Please read them carefully.

1. Acceptance of terms

By accessing Oyeba (oyeba.com), you agree to be bound by these Terms of Service, our Privacy Policy and our Cookie Policy. If you don't agree, don't use the service.

2. Service description

Oyeba is a project coordination platform designed for the African diaspora and their loved ones. The service includes: project creation, milestone management, multi-media proof uploads, messaging, roles and permissions.

3. User account

You must be at least 16 to create an account. You are responsible for keeping your credentials confidential and for all activity on your account. Notify us immediately at security@oyeba.com in case of unauthorized use.

4. Acceptable use

You agree not to: (a) violate any applicable law; (b) post hateful, illegal, or rights-infringing content; (c) attempt to bypass security mechanisms; (d) use the service for spam or fraud. We reserve the right to suspend any account that violates these rules.

5. User content

You retain full ownership of the content you post (proofs, messages, project descriptions). You grant us a limited license to store, display and transmit this content to the members of your projects, solely for the purpose of the service.

6. Payment & subscription

Some plans are paid. Prices are shown on the Pricing page. Payments are charged monthly or yearly per your choice. You can cancel anytime from your settings; access continues until the end of the paid period.

7. Termination

You can terminate your account anytime. We may terminate your access in case of serious violation of these terms. Upon termination, you have 30 days to export your data before permanent deletion.

8. Limitation of liability

Oyeba is provided "as is". To the extent permitted by law, our liability is limited to the amount paid in the last 12 months. We are not liable for indirect damages (loss of profit, data loss caused by your negligence, etc.).

9. Modifications

We may modify these terms. Substantial changes are notified by email and an in-app banner 30 days before they take effect. Continued use after that period constitutes acceptance.

10. Governing law & jurisdiction

These terms are governed by French law. Any dispute falls under the jurisdiction of the courts of Paris, except for legal provisions in favor of consumers.

11. Provider marketplace

Oyeba offers a marketplace allowing diaspora clients to book services from verified local providers (mason, electrician, courier, agronomist, etc.). Any user may apply to become a provider. This application requires a mandatory identity verification (KYC), including submission of an ID document, a selfie, a proof of address, and geolocation at submission time. Oyeba manually validates each application within 48 business hours. Approval triggers the creation of a public profile with portfolio, offered services, and contact details. The profile remains subject to annual re-verification. Oyeba may suspend or ban a provider for failure to comply with these terms, repeated complaints, proven fraud, or non-compliance with re-verifications. Providers remain free to set their own prices (for personalized services); for some standardized services (delivery, mail drop-off), Oyeba sets a single price.

12. Escrow payments and commission

Client payment is collected by card via our payment provider Stripe (regulated European Electronic Money Institution). Funds are held in an Oyeba escrow account until service delivery. Seven days after the provider confirms delivery, payment is automatically released to the provider via mobile money transfer (PawaPay or Onafriq depending on country). Oyeba retains a 10% commission on each transaction (indicative rate, subject to change with 30-day notice). Stripe fees (1.4% + €0.25 per transaction) and FX fees (~1%) are absorbed by Oyeba from the commission share. The provider therefore receives the gross amount minus Oyeba's commission (90% by default). The client is informed of the total price including all taxes at order time; no hidden fees are added.

13. Cancellation and refund

The client may cancel their booking at no cost as long as the provider has not yet accepted it (100% refund). After acceptance, a cancellation by the client triggers a 50% refund of the amount paid; the remaining 50% is paid to the provider as compensation for their commitment and lost opportunity. The provider may decline a booking within 24h of the order (100% refund to client). Beyond acceptance and after service has started, no cancellation is possible without going through the dispute procedure (article 14). Stripe refunds are processed automatically and arrive on the client's card within 5 to 10 business days depending on the bank. Client silence beyond 7 days after delivery confirmation constitutes tacit validation and releases payment to the provider.

14. Disputes and conflict resolution

In the event of disagreement between client and provider on quality or conformity of delivered service, either party may open a dispute via the platform. The relevant booking is immediately frozen (payment remains in escrow). The Oyeba support team acknowledges receipt within 24h, examines evidence submitted by both parties (messages, photos, documents) within 48h, and renders a decision within 5 business days. Possible decisions are: (a) resolution in favor of client (100% refund), (b) resolution in favor of provider (payment release), (c) fair resolution (50/50 split). For disputes above €500 or where evidence remains contradictory, Oyeba may recommend the use of a bailiff for on-site verification; costs are borne by the losing party. Oyeba decisions do not exempt parties from their usual legal recourse before competent French courts (article 19).

15. Reviews and moderation

After a service is completed, the client has 30 days to leave a review of the provider: mandatory 1-5 star rating and optional text comment (10-1000 characters). Maximum one review per booking. Reviews with rating ≤ 2 or containing language identified as abusive (list maintained by Oyeba) are automatically hidden and submitted to moderation within 48h. Oyeba reserves the right to permanently hide a review that is clearly defamatory, off-topic or contrary to good morals, without recourse for the client. The provider cannot publicly respond to reviews in V1.1 (feature planned for V2). Reviews are public on the provider's profile; no review may be deleted upon simple provider request outside of a formal moderation procedure.

16. KYC data and retention

KYC documents (ID document, selfie, proof of address, geolocation data) are collected for the sole purpose of verifying the identity and legitimacy of the provider, and preventing fraud. These documents are stored encrypted in a private bucket hosted on our self-hosted Supabase instance (Germany / European Union), accessible only by the Oyeba administrator team via time-limited signed URLs (5 minutes). KYC documents are retained for 30 days after approval or rejection of the application, then automatically purged. Audit metadata (who submitted, who decided, when) is retained for 5 years for accounting and compliance purposes. The provider has at any time a right of access, rectification, deletion and portability in accordance with GDPR (see privacy policy).
